Misdemeanor & Felony Computer Crime Penalties in Iowa

Cyber crime is not one offense in Iowa, and penalties depend on which statute applies.

Unauthorized Computer Access

Under Iowa Code § 716.6B, unauthorized computer access is not graded by dollar value. It is an aggravated misdemeanor if the data accessed contains a confidential record, utility or airport operational data, or a trade secret; a serious misdemeanor if data is copied, altered, or deleted; and a simple misdemeanor otherwise.

Identity Theft

Under Iowa Code § 715A.8, identity theft is graded by value: an aggravated misdemeanor at $1,500 or less, a Class D felony from $1,500 to $10,000, and a Class C felony above $10,000.
