How Long Can My License Be Suspended For After an OWI?
How long your license will be suspended for can vary based on a few different factors. Here are some general guidelines:
- First offense: 180 days
- Second offense within 12 years: One year
- Third offense: Six years
Some other factors can complicate your case and make your punishments harsher. For example, if you refuse the breathalyzer you could lose your ability to drive for up to a year on your first OWI.
How Can I Get My License Back?
If you want to get your license back, you usually need to wait until the revocation or suspension period ends. Then you must:
- Pay your $200 civil penalty
- Complete an approved drinking driver course and submit evidence of course completion
- Complete an approved substance use treatment or rehab service
- Provide proof that any vehicle you drive has had an ignition interlock device installed
- Secure SR-22 insurance and submit proof of it
- Continue to provide proof of SR-22 insurance when asked over the next two years
Once all of these tasks are completed, you can drive again.
Is There a Way to Get My License Back Quickly?
Not being able to drive can be a major inconvenience, so we’re not surprised when a client asks if there are ways to get their license back faster. You may be eligible to receive a temporary restricted license that would allow you to drive for absolute necessities, like going to work or for reasons relating to child care. Not just anyone can ask for this though.
You can get a temporary restricted license if you are convicted of an OWI and you do not have another conviction or revocation on your record over the last 12 years. If this describes you, you may be able to get your license back early, albeit in an extremely limited capacity.
